TERMS AND CONDITIONS
By accessing or using Shah Foods official website, you are
acknowledging that you have read, understand, and agree, without
limitation, to be bound by these Terms and Conditions.
CUSTOMER PRIVACY POLICY
Shah Foods shall take all reasonable steps to protect the personal
information of users. For the purpose of this clause, “personal
information” shall be defined as detailed in the Promotion of Access to
Information Act 2 of 2000 (PAIA).
AGREEMENT OF SALE
We will notify you by email as soon as possible to acknowledge receipt
of your order. If we are unable to fulfill your order following this
acknowledgement, we will contact you by email or telephone advising you
of this. If you require any information concerning your order please
email us at shahorders@mweb.co.za.
An agreement of sale comes into effect when either a credit card
authorisation is received from the issuing bank, or a bank transfer is
reflected on our bank statement.
We may not accept your order if an item you have ordered is out of
stock, if we have identified a product or pricing error or if we are
unable to obtain authorisation for your payment. Please note that we
reserve the right to reject any offer to purchase by you at any time.
LEGALLY BINDING CONTRACT
Please remember that when we accept your submitted order for products
from this website, there will be a legally binding contract.
PAYMENT
Payment can be made by any of the following methods: Electronic Funds
Transfer (details will be available on request) or Visa/Master Credit
Card. Payment will be debited and cleared from your account at the
point at which your order is acknowledged. Please note that all credit
cardholders are subject to validation checks and authorisation by the
issuer of the card. The cardholders address must match the information
held by the issuing authority. If the issuer of your payment card
refuses to pay or does not for any reason authorise payment to Shah
Foods, we will not be liable for any delay or non-delivery of products.
Please note that we retain the legal ownership of all products until
full payment has been made by you and received by us. Legal ownership
of the products will immediately transfer back to us if we refund any
payment for the products to you.
Credit card acquiring and security
Credit card transactions will be acquired for Shah Foods via Payfast
who is the approved payment gateway. Payfast uses the strictest form of
encryption, and no credit card details are stored on the website. Users
may go to www.payfast.co.za to view their security certificate and
security policy.
Customer details separate from card details
Customer details will be stored by Shah Foods separately from card
details which are entered by the client on payfast’s secure site. For
more detail on payfast refer to www.payfast.co.za
Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options
to the cardholder is South Africa. Transaction Currency is South
African Rand (ZAR).
Delivery policy
Subject to availability and receipt of payment, orders will be
processed within 2 days and delivery confirmed by way of a telephone
call.
DELIVERY
Pre-delivery arrangements for orders will be made telephonically. If
you are not at address entered for delivery order arrives, the company
will contact you regarding the order. You accept that in order for us
to prove delivery of an order or part of an order, we do not have to
prove you personally received the goods, but that any person at the
delivery address specified on your order, signed for the delivery.
INSPECTION
You should inspect the products upon receipt and check that everything
specified on the invoice is included. You will be deemed to have
accepted the order unless you notify us upon receipt that there is a
problem or you wish to cancel the order and/or you return the goods in
accordance with our Returns Policy. If you fail to take such action, we
are not obligated to accept any rejection by you of the products at a
later date.
RETURNS
The returns policy is for goods purchased on the website.
Shah Foods hopes that you will be happy with your purchases. However,
if for any reason, you are not completely satisfied with the products
ON THE DAY OF DELIVERY, we will be happy to offer a refund, exchange or
replace all products returned to us on that day of delivery provided
that they are in their original, unopened, unused and undamaged
condition. We will consider the condition of the goods being returned
when making a refund.
Should you wish to cancel your order please do so within 24 hours of
placing the order online.
Should you wish to return any products, please notify us immediately
when the delivery of the products are made by calling us on the
following number 0219320069 (open Monday to Friday 8.00 am to 5.00 pm).
The business will be closed from 12.30 pm to 1.45 pm every Friday)
Please provide full details of the customer name, invoice number and
the products which are being cancelled or returned. On receipt of the
returned goods we will give you a refund of the amount paid for the
products. Refunds will be made against the original form of tender.
Country of domicile
This website is governed by the laws of South Africa and Shah Foods
chooses as its domicilium citandi et executandi for all purposes under
this agreement, whether in respect of court process, notice, or other
documents or communication of whatsoever nature, 46 Epping Avenue,
Elsies River, Cape Town, 7490.
Variation
Shah Foods may, in its sole discretion, change this agreement or any
part thereof at any time without notice.
